1. Introduction Welcome to the GK Elite Custom Store, operated by SV Sports ("we," "us," or "our") on behalf of Elite Sportswear L.P. (GK Elite). These Terms of Service ("Terms") govern your access to, and use of this website and the products and services offered. By accessing or using this site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you may not access the website.
2. About Us SV Sports has a fulfillment services agreement with GK Elite that covers products and designs that are associated with GK Elite, however all transactions, payments, customer service inquiries, and order fulfillment are handled directly by SV Sports.
3. Account Creation To place an order, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Product Information and Availability We strive to display accurate product information, including descriptions, images, and pricing. However, we do not guarantee that the information is error-free. All products are subject to availability, and we reserve the right to limit the quantities of any products or services that we offer.
5. Orders, Payment, and Billing
● Order Acceptance: All orders placed through the website are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in the description or price of the product, or error in your order.
● Payment Processing: All payments are collected and processed by SV Sports. We accept various payment methods as indicated on the website. You agree to pay all charges incurred by you or any users of your account at the prices in effect when such charges are incurred.
● Billing Information: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
6. Shipping and Delivery
● Fulfillment: All orders are fulfilled and shipped by SV Sports.
● Shipping Times: Estimated shipping times are provided for your convenience but are not guaranteed. Delays may occur due to unforeseen circumstances.
● Risk of Loss: The risk of loss and title for all products purchased from the website pass to you upon our delivery to the carrier.
7. Returns and Exchanges
● Policy: Our return and exchange policy is governed by SV Sports. Please refer to our separate Return Policy page for detailed information on eligibility, process, and any applicable fees.
● Custom Items: Please note that custom-designed or personalized items may not be eligible for return or exchange unless there is a defect in the product or an error on our part.

9. Intellectual Property
● GK Elite: The GK Elite name, logo, and certain designs are the intellectual property of GK Elite. Your use of this site does not grant you any rights to use this intellectual property.
● SV Sports: The SV Sports name, logo, and website content are the intellectual property of SV Sports. You may not reproduce, duplicate, copy, sell, or exploit any portion of the service, use of the service, or access to the service without our express written permission.
● Design Representations and Warranties. With respect to Your Design Contribution, You represent and warrant the following: (i) You either own all rights, title, and interest in Your Contribution or have the full right, power and authority to grant the rights granted herein, free and clear of any claims, liens, encumbrances, or violations of any other agreement; (ii) Your Contribution is either your original work or You maintain all rights necessary from third parties in order to submit and allow Omni Cheer to utilize Your Contribution in connection with the Order; (iii) Your Contribution does not and will not violate, misappropriate, or infringe the rights of another party (or person) including, without limitation, patent, trademark, trade secret, copyright, publicity, privacy or other proprietary rights, and use by Omni Cheer does and will not violate any applicable laws, (iv) Your Contribution does not impersonate or misrepresent Your affiliation with any person, organization, team, or entity, (v) You are not aware of any investigation, claim, or litigation involving Your Contribution; (vi) Your Contribution does not contain or depict text or imagery that is threatening, defamatory, libelous, deceptive, fraudulent, or sexually explicit; and (vii) You are at least of the legal age of majority and have every right to contract in Your own name.
10. Limitation of Liability In no case shall SV Sports, GK Elite, our directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.
11. Governing Law This contract shall be governed by the laws of the Commonwealth of Pennsylvania, United States of America, excluding its principles of conflict of laws. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to the sale of Products.
12. Changes to Terms of Service We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website following the posting of any changes constitutes acceptance of those changes.
